By accessing, browsing, or using the Dukancard platform (including our website, mobile applications, and related services, collectively the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

We may revise these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. We encourage you to review this page periodically.

Dukancard is a hyperlocal commerce platform that enables:

• Customers to discover local businesses, browse product catalogs, place orders, and arrange pickup or delivery.
• Businesses to create digital storefronts, manage product listings, process orders, and receive payments.
• Riders to accept and fulfill delivery assignments.

The Platform facilitates transactions between these parties but does not itself sell products or provide delivery services directly. Businesses listed on Dukancard are independent third-party merchants.

You may use the Platform only if you:

• Are at least 18 years of age (or the age of majority in your jurisdiction).
• Have the legal capacity and authority to enter into a binding agreement.
• Are not currently barred or suspended from using the Platform by Dukancard.

To access certain features, you must register an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your credentials and not share your account with others.
• Promptly update your information if it changes.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or otherwise harmful activity.

If you register as a business owner, additional terms apply:

• You represent that your business is legally registered and authorized to operate in your jurisdiction.
• You are responsible for obtaining any licenses, permits, or approvals required to sell your products.
• You must provide accurate business information including address, contact details, and tax identification where applicable.
• You agree to fulfill all orders placed through the Platform in a timely and professional manner.
• You acknowledge that Dukancard may collect and process payments on your behalf through our payment partners, and that platform commissions and settlement terms apply as described in our separate merchant agreement or pricing schedule.
• You may be required to complete a KYC (Know Your Customer) verification process before accessing certain features or tiers on the Platform.

When you place an order through the Platform:

• The order constitutes an offer to purchase from the merchant. The merchant may accept or decline the order.
• Payments are processed through our payment-service providers (e.g., Razorpay in India). By using the Platform, you agree to the payment-provider terms as well.
• Funds may be held in an escrow-like workflow until the order is fulfilled and verified (e.g., via QR-code scan at pickup).
• Refunds, cancellations, and disputes are subject to the merchant's policies and applicable consumer-protection laws.
• All prices are displayed in the local currency of the country you are browsing (e.g., INR for India).

If you use the Platform as a delivery rider:

• You agree to follow all applicable traffic, safety, and local laws while performing deliveries.
• You are responsible for maintaining any vehicle, license, or insurance required for delivery work.
• Dukancard acts as a facilitator connecting riders with delivery assignments and does not act as an employer.

The Platform includes social features such as posts, comments, likes, and follows. By using these features, you agree that:

• You are solely responsible for the content you post.
• You will not post content that is illegal, defamatory, harassing, infringing, or otherwise objectionable.
• Dukancard may, at its discretion, remove or moderate content that violates these Terms or community guidelines.
• You grant Dukancard a non-exclusive, worldwide, royalty-free license to display and distribute the content you post on the Platform for the purpose of providing the service.

The Platform and its original content, features, branding, and technology (excluding user-generated content and merchant listings) are owned by Dukancard and its licensors and are protected by intellectual-property laws.

You may not copy, reproduce, modify, distribute, or create derivative works from the Platform without our express written consent.

You agree not to:

• Use the Platform for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to any portion of the Platform, user accounts, or related systems.
• Interfere with or disrupt the Platform's functionality (e.g., introducing malware, scraping data, overloading servers).
• Impersonate another person or entity, or misrepresent your affiliation.
• Collect or harvest user data without authorization.
• Circumvent or attempt to circumvent any rate limits, access controls, or security measures.

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

DUKANCARD DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL CODE. YOU USE THE PLATFORM AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUKANCARD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

IN NO EVENT SHALL DUKANCARD'S TOTAL LIABILITY EXCEED THE GREATER OF ONE HUNDRED INDIAN RUPEES (INR 100) OR THE AMOUNT YOU HAVE PAID TO DUKANCARD IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Dukancard and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

Dukancard may suspend or terminate your access to the Platform at any time, with or without cause or notice, including if we believe you have violated these Terms.

Upon termination, provisions that by their nature should survive (including intellectual-property rights, disclaimers, limitation of liability, and indemnification) will continue in effect.

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the jurisdiction of Dukancard's principal place of business.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dukancard regarding your use of the Platform.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
• No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent.
